Terms of Service

These Terms of Service ("Terms") govern your use of Free Pod Summaries (the "Service"), operated by Dominic Maskell Enterprises LLC, a limited liability company registered in the State of California, United States ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. The Service

Free Pod Summaries is a free, automated service that uses artificial intelligence to generate summaries of publicly available podcast episodes. Summaries are delivered to your email inbox based on the podcasts you subscribe to.

The Service operates by processing publicly available podcast RSS feeds and audio content. We do not host, redistribute, or make available any original podcast audio, video, or full transcripts. Summaries are short, transformative, commentary-style digests intended for personal, non-commercial use.

2. Account Registration

  • You must provide a valid email address to create an account.
  • You must verify your email address via a magic link before you can use the Service.
  • You are responsible for maintaining access to your email account.
  • You must be at least 16 years old to use the Service.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Create multiple accounts to circumvent any service limitations.
  • Attempt to access, tamper with, or use non-public areas of the Service, its systems, or its technical delivery systems.
  • Use automated means (bots, scrapers) to access or interact with the Service without our prior written consent.
  • Interfere with or disrupt the Service or the servers or networks connected to the Service.

4. AI-Generated Content — No Liability

You acknowledge and agree that all summaries provided by the Service are generated entirely by artificial intelligence with no human editorial review.

  • Summaries may contain errors, omissions, inaccuracies, misrepresentations, or content that is misleading, offensive, or inappropriate. They are not a substitute for listening to the original podcast episode.
  • We do not verify, endorse, or take any responsibility for the accuracy, completeness, reliability, or suitability of any AI-generated summary.
  • Summaries are provided for general informational purposes only. You must not rely on them for professional, legal, medical, financial, or any other form of advice.
  • We accept no liability whatsoever for any loss, damage, injury, or harm arising from your use of, reliance on, or actions taken based on AI-generated summaries, including but not limited to inaccurate information, harmful suggestions, or omitted warnings present in the original content.
  • You use the summaries entirely at your own risk.

5. Podcast Content & Copyright

All original podcast content (audio, titles, descriptions, artwork) belongs to and remains the intellectual property of the respective podcast creators, publishers, and rights holders.

  • We do not claim ownership of any original podcast content.
  • We do not store, host, redistribute, or make available any original podcast audio files. Audio is streamed temporarily for AI processing and is never persisted.
  • Summaries are short, transformative works that comment on and reference the ideas discussed in podcast episodes. They are substantially shorter than the original content, do not reproduce the original expression, and are intended to serve a different purpose (quick reference vs. full listening experience).
  • Our use of publicly available RSS feed metadata (titles, descriptions, publication dates) is consistent with the intended purpose of RSS: to enable discovery and syndication of content.
  • If you are a podcast creator or rights holder and have concerns about our summaries, you are welcome to contact us at hello@freepodsummaries.com. We will review correspondence we receive at our sole discretion. We do not commit to any specific response time, to removing or modifying any content, or to notifying any third party (including subscribers) of any action we may or may not take.

6. Copyright Concerns

We do not believe the Service infringes any third-party rights. If you nonetheless have a copyright concern, you may write to us at hello@freepodsummaries.com. To help us evaluate your correspondence, we suggest you include:

  • Identification of the work you believe is affected.
  • Identification of the specific material on the Service you wish to draw to our attention.
  • Your contact information.
  • The basis on which you believe you are entitled to raise the concern.

We will review such correspondence at our sole discretion. We make no representations, warranties, or commitments regarding our response, including (without limitation) any timeframe for response, any obligation to remove, modify, or retain content, or any obligation to notify subscribers, users, or any other third party of correspondence received or actions taken. Nothing in this section constitutes a designation of an agent under, or compliance with, any specific statutory notice-and-takedown regime, and no such designation or compliance is intended.

7. Service Availability

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not guarantee uninterrupted or error-free operation of the Service.
  • We may modify, suspend, or discontinue the Service (or any part of it) at any time without prior notice or liability.
  • We may impose limits on the number of podcast subscriptions or summaries delivered per day.

8. Pricing & Advertising

The Service is provided free of charge. To support the Service, we may include advertisements or sponsored content at the bottom of summary emails. We reserve the right to introduce paid features, premium tiers, or other monetisation methods in the future, in which case we will provide reasonable advance notice.

9. Account Termination

  • You may delete your account at any time. Upon deletion, all your personal data and subscription preferences will be permanently removed.
  • We may suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to the Service or other users.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we expressly disclaim all liability in connection with the Service:

  • We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses.
  • We are not liable for any loss, damage, injury, or harm caused by inaccuracies, errors, omissions, or misleading content in AI-generated summaries, regardless of whether we were advised of the possibility of such damages.
  • We are not liable for any actions you take (or fail to take) based on information contained in our summaries.
  • Our total aggregate liability to you for any claims arising from the Service shall not exceed the total amount you have paid us for the Service (which is zero for the free tier).
  • We are not liable for any third-party content, including the original podcast content that our summaries reference.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by applicable law.

11. Disclaimer of Warranties

The Service, including all AI-generated content, is provided on an "as is" and "as available" basis. We make no warranties or representations of any kind, express or implied, regarding the Service, including but not limited to:

  • The accuracy or reliability of any AI-generated summary.
  • The suitability of the Service for any particular purpose.
  • That the Service will be uninterrupted, secure, or error-free.
  • That any defects or errors in the Service will be corrected.

12. Indemnification

You agree to indemnify, defend, and hold harmless Dominic Maskell Enterprises LLC, its officers, members, employees, and affiliates, and Free Pod Summaries, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of California, and you consent to personal jurisdiction in those courts. Nothing in this clause limits any mandatory consumer-protection rights you may have under the laws of your country of residence.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
